Mediation Steps
The Basics Of Mediation
Mediation is a conflict resolution process where a neutral third party, the mediator, helps the parties in a dispute find common ground and mutually agreeable resolutions. Unlike litigation, which pits parties against each other, mediation is a nonadversarial process that involves open dialogue and negotiation. The mediator facilitates discussions and proposes solutions but does not make or enforce a decision.
While mediators are often attorneys, the role of a mediator is different from that of an attorney. Mediators do not represent individual parties or take sides. Rather, our role is to foster communication and help parties explore options for resolution. In this role, we do not provide legal advice or represent any party. However, you can opt to have a lawyer represent you during mediation to protect your interests and offer legal counsel.

The Advantages Of Mediation Over Litigation
As a form of alternative dispute resolution, facilitative mediation offers numerous benefits, particularly in comparison with traditional litigation. Two key advantages of mediation are that it’s more cost-effective and it takes less time. Mediation provides an opportunity to resolve disputes much more quickly than litigation, which can take months or years. As a result, it is generally much less expensive than going to court.
Mediation proceedings are private and confidential. Unlike court proceedings, they are not part of the public record. Mediators also have the freedom to approach conflict resolution from different angles. Unlike judges, who are bound by legal and procedural rules, mediators can tailor the negotiation process to fit the needs of both parties.

Mediation Preserves Relationships And Minimizes Conflict
The parties involved in mediation have more direct involvement in the decision-making process than is possible through litigation. By encouraging cooperation between parties and focusing on finding common ground rather than gearing up for battle, mediation can help maintain amicable relationships between the parties long after the dispute is over.
