Types Of Bankruptcy

In both Chapter 7 and Chapter 13, you may experience protection from creditors and debt collection companies as soon as you file, through a feature called the “automatic stay.” Either Chapter 7 or Chapter 13 may help you eliminate the majority of your debts. When your bankruptcy is completed, you have the ability to build up your credit in the future after getting rid of most of your debt.


One main difference between Chapter 7 and Chapter 13 is the length of time dedicated to finalizing them. Other distinguishing features are described below.


  • Chapter 7 is typically handled within 6 months. Payment for legal and court fees must be made upfront.
  • Chapter 13, however, can take up to 3 to 5 years. Costs of the bankruptcy are built into affordable payments over this period of time.
  • Chapter 11 bankruptcy is mostly common for businesses. It is used by corporations of any size and large companies. Once a business files for Chapter 11 bankruptcy, the business can often stay open and if possible, rebuild financial stability while the bankruptcy runs its course.
